By accessing or using WatchUm (a service of Hours & Co., LLC — the "Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use our service. These Terms include a binding arbitration agreement and a class-action waiver in Section 17, which affect your legal rights. Please read them carefully.
You must be at least 18 years old and able to form a legally binding contract to use WatchUm. By using the service, you represent and warrant that you meet these requirements and that all information you provide is accurate.
WatchUm aggregates, organizes, and displays publicly available government records — crime incident data published by the local police department and registered sex offender counts published by the Texas DPS Public Sex Offender Registry — for residential properties in Austin, TX. We present this information to help users make informed housing decisions.
WatchUm is a passive republisher of pre-existing public records. We do not create, author, investigate, verify, editorialize, or independently confirm the underlying data. The content originates solely from third-party government sources. We do not control what those agencies report, how they classify incidents, or the accuracy of their records. Any question or dispute regarding the accuracy or content of an underlying record must be directed to the originating agency, which is the only entity with authority to correct its own records.
WATCHUM IS NOT A CONSUMER REPORTING AGENCY AS DEFINED BY THE FAIR CREDIT REPORTING ACT (FCRA), 15 U.S.C. § 1681 ET SEQ., AND THE INFORMATION WE PROVIDE IS NOT A "CONSUMER REPORT." You may not use WatchUm or any data obtained from it, in whole or in part, for any purpose regulated by the FCRA, including but not limited to:

We may suspend or terminate access immediately, without refund, for any violation of this section, and may report unlawful conduct to law enforcement.
If you are the subject of a record displayed on WatchUm, or believe information shown is inaccurate, outdated, or raises a safety concern, you may submit a request to support@watchum.io. Because we republish government records and do not control the source data, we cannot alter the official record — corrections to the underlying record must be pursued with the originating agency (the Austin Police Department or the Texas DPS). However, we will review good-faith requests within a reasonable time and, at our discretion, may mask, suppress, or remove specific content from our display or notifications, particularly where victim privacy or personal safety is implicated. Submitting a request does not guarantee a particular outcome.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods. Subscriptions automatically renew until cancelled; by subscribing you authorize us (and our payment processor) to charge the applicable recurring fee at the start of each billing period until you cancel.
WatchUm's design, code, branding, and presentation of data are protected by copyright and other intellectual property laws. The underlying government records are public records; our compilation, arrangement, and presentation of them are ours. You may not copy, reproduce, or distribute our content without permission.
The service and all data are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, or that the data is accurate, complete, current, or reliable. You use the service and rely on the data entirely at your own risk.
To the maximum extent permitted by law, Hours & Co., LLC and its members, officers, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, property, or personal injury, arising out of or relating to your use of (or inability to use) the service or the data, even if advised of the possibility of such damages. This includes, without limitation, liability for:
Our total aggregate liability for any and all claims relating to the service shall not exceed the greater of (a) the total amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless Hours & Co., LLC and its members, officers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the service or the data; (b) your violation of these Terms, including the Acceptable Use restrictions in Section 6; (c) your violation of any law or the rights of any third party, including any claim that your use of the data harassed, defamed, or injured another person; or (d) information you submit through the service.
Your use of WatchUm is also governed by our Privacy Policy.
To reduce the risk of identifying or discouraging victims, WatchUm may mask certain highly sensitive incident categories and may withhold precise incident-location details in some views or notifications. We reserve the right to apply, expand, reduce, or disable that masking at our discretion in the interest of victim privacy and safety.
We reserve the right to modify these Terms of Service at any time, for any reason, at our sole discretion. When we make changes, we will update the "Last Updated" date at the top of this page. We may also notify you by email or by posting a notice in the service, but we are not obligated to do so. Your continued use of WatchUm after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the service.
We reserve the right to discontinue, suspend, or shut down WatchUm, in whole or in part, at any time and for any reason, with or without notice. In the event of a permanent site closure:
We may suspend or terminate your individual access to WatchUm at any time for violations of these Terms or for any other reason. Upon termination for cause, no refunds will be issued for remaining subscription time.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
Binding Arbitration. Except as set out below, any dispute, claim, or controversy arising out of or relating to these Terms or the service shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in Travis County, Texas, or, at your election, by telephone or video, or based on written submissions. Judgment on the award may be entered in any court of competent jurisdiction.
Class-Action Waiver. You and Hours & Co., LLC agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of a representative or class proceeding.
Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or equitable relief in a court of competent jurisdiction in Travis County, Texas, to protect its intellectual property or to stop unauthorized use of the service. If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall be severed and may proceed in court.
Opt-Out. You may opt out of this arbitration agreement by emailing hello@watchum.io within 30 days of first accepting these Terms, stating your name and intent to opt out. Opting out does not affect any other provision of these Terms.
